Many moons ago, Amodeo was reading bankruptcy case notes in a big red folder, and saw how a real difference could be made in people's lives. Amodeo was shocked how nobody was truly doing it beforehand, soon convincing him that he wanted to practice. He enjoyed winning the impossible cases, and indeed, he won.
Aaron Bates, Esq. Speaking with Another Attorney
Amodeo practiced in Atlanta, GA, and specialized mostly in bankruptcy. Since most bankruptcy clients have other legal issues, Amodeo gained experience in virtually every area of law.
A difficulty Amodeo faced when practicing law was when clients couldn't afford to pay for a quality job. Amodeo tried to be creative and dedicate his time, but these are issues such as not affording to print copies or being able to call in an expert witness. Despite it all, Amodeo came up with the best solutions whenever he could.
Within 3 years of obtaining his license, Amodeo had become one of the most prolific bankruptcy attorneys in the country.
Amodeo developed a particular expertise in filing Chapter 11's for wealthier individuals who nevertheless, needed bankruptcy release. Historically, Chapter 11 Relief is used for reorganizing businesses. Amodeo's innovation of the law provided assistance for individuals by treating them as if they were commercial entities.
Early into Amodeo's law practice days, he offered to be the on-duty weekend attorney because he was single at the time. One afternoon, a woman came in for a consultation and explained how her son had been in jail for the last couple of months without any set bail. Amodeo assured the woman that he would see her son, hear his story, and make sure he's alright.
Her son had been charged with armed robbery with a bomb and terroristic threats. He convinced Amodeo that he was innocent, and that he hadn't committed the crime. He wanted a polygraph examination and agreed to live by the results. That day, Amodeo took the case.
The family was not very wealthy, so Amodeo agreed to installment-style billing - only $50 a month. When Amodeo got back to the firm, every one said he was wrong, and easily should've taken 75k for a plea. Amodeo lived by his agreement with his new clients.
On the first day, Amodeo showed up for the man's Motion for Bail. The Judge said, "Mr. Ahm-ooh-dee-oh, calling your case next. I see you have a bail motion set, it's DENIEEED." - A real southern drawl! Further, the Judge said, "TRIAlL, 30 days."
At the time, Amodeo was not allowed to try criminal defense cases, he hadn't gotten the certification from the bar. With his southern drawl, the Judge said, "Mr. Amodeo, is Mr. Smith still running the bar?" Amodeo replied, "Yes, Sir." Finally, the Judge then said, "Good. Tell him I said you're going to try this case. I'll see you in 30 days."
VIDEO COMING SOON.
Amodeo came into court before Judge Kahn. He had a complicated financial argument on how to value automobiles, so his client could benefit from it and keep his possession(s). Amodeo made the demonstration and thought it was successful, as the Judge said he would take it under advisement.
Afterwards, Amodeo went downstairs, because Atlanta courtrooms were in large towers. As he approached the exit, secret service came up to him and said, "go back upstairs and see the Judge." Amodeo went upstairs, entered the Judge's chambers, to hear, "Young man, sit down (Amodeo was 29 at the time). If you EVER do that to me again, you BETTER have a toothbrush packed, because I'm going to put you in contempt for as long as I can keep you there!"
Further, the Judge said, "I got one clerk. You filed your brief two days ahead of time, I don't understand any of that math! And, you're surprising me so I look like a fool not knowing what you're talking about! Give me plenty of time, so I don't look bad. There is a whole room of attorneys out there and everybody is lost except you! The right thing is, you give me at least a week, so I can know at least something you're talking about!"
That day, Amodeo learned a very important lessons about judges.
Amodeo learned that judges don't know everything, and it is the attorney's job to educate them in advance about the facts and the law. Judges are never supposed to be surprised. He also developed a great deal of respect for Judge Kahn on the proper way to behave.
